Terms of the JKLM shop and configurator

1. Seller and contact

The website jklm.eu is operated by JKLM Firma Usługowa Łukasz Kaczmarek, tax ID (NIP) 7532159822, ul. Brzozowa 6A, 48-385 Otmuchów, Poland (hereinafter: JKLM).

2. Definitions

• Website – jklm.eu including the configurator (studio) and forms.
• Customer – a natural or legal person or organisational unit using the Website.
• Consumer – a Customer who is a consumer within the meaning of Art. 22¹ of the Polish Civil Code.
• Sole trader with consumer rights – a natural person running a business who concludes a contract directly related to that business which is not of a professional nature for them (Art. 7aa and 38a of the Polish Consumer Rights Act).
• Estimated price – the amount calculated automatically on the Website from the parameters chosen by the Customer.
• Quotation – an individual proposal from JKLM sent to the Customer on a durable medium (email or PDF), setting out the subject, price, deadline and other terms of the contract.
• Contract – a contract for the manufacture and delivery of signage (e.g. a lightbox, pylon or print), possibly with installation, concluded on the basis of the Quotation.

3. Services provided on the Website

JKLM provides the following free of charge on the Website: the configurator with product preview and estimated price, saving of projects and their versions, a project preview link, enquiry forms and, where available, an AI-assisted designer.

The contract for these electronic services is concluded when the Customer starts using a given function and lasts until they stop. The Customer may stop using the Website at any time and request deletion of saved projects by writing to biuro@jklm.eu.

To use the Website you need an up-to-date browser with JavaScript, cookies and browser storage enabled and, for the 3D preview, WebGL support. An email address or phone number is needed to send an enquiry.

Supplying unlawful content, content infringing third-party rights or malware is prohibited. Files are checked by a virus scanner; a file that does not meet the requirements may be rejected.

4. Estimated prices

• The estimated price is calculated according to the JKLM price list in force at the time of calculation. It is shown in złoty as a gross amount including 23% VAT; the German and English versions also show it in euro at the National Bank of Poland (NBP) average rate.
• The estimated price does not include installation, foundations, electrical connection, transport requiring an individual quote or building formalities unless the Quotation states otherwise.
• Estimated prices, descriptions and visualisations on the Website are not an offer within the meaning of Art. 66 of the Polish Civil Code but an invitation to conclude a contract. The binding price is set in the Quotation.
• For Customers outside Poland, the VAT rate and treatment are set in the Quotation in line with the law and the buyer's status.

5. Enquiry, Quotation and conclusion of the Contract

• Sending an enquiry or request via the Website does not conclude a Contract or create an obligation to pay.
• After checking the design, structure and installation site, JKLM sends a Quotation. It contains the total price including taxes, the completion date, payment, delivery and installation terms and, for Consumers, the information required by law, including on the right of withdrawal or its absence.
• The Contract is concluded when the Customer accepts the Quotation in the manner indicated in it (e.g. by replying by email). If the Quotation provides for an advance payment, production starts once it has been received.
• The Website does not accept online payments. Payments are made by bank transfer to the account stated on the invoice or in the Quotation.

6. Artwork and Customer files

• The Customer declares that they hold the rights to the files, marks and content they submit and that using them to make the signage does not infringe third-party rights.
• The Customer grants JKLM a non-exclusive, free licence to use the files to the extent necessary to prepare the Quotation and perform the Contract.
• Before production, JKLM sends the production design for approval. Changes after approval may affect the price and deadline.
• JKLM may refuse to produce a design containing unlawful content or content that infringes third-party rights.
• JKLM may show the completed signage in its portfolio unless the Customer objects.

7. Production, delivery and installation

• The completion date, method of delivery or collection and scope of installation are set out in the Quotation.
• Installation requires access to the site, a substrate with adequate load-bearing capacity, an electrical connection and the consent of the property owner or manager.
• The Customer is responsible for obtaining the required consents, notifications or permits (e.g. for a free-standing pylon) and for the signage complying with the local landscape resolution, unless the Quotation includes JKLM handling these formalities.

8. Right of withdrawal

A Consumer or sole trader with consumer rights who has concluded a distance Contract may withdraw from it within 14 days without giving a reason, subject to statutory exceptions.

There is no right of withdrawal for a Contract concerning non-prefabricated goods made to the Customer's specifications or clearly personalised (Art. 38(1)(3) of the Polish Consumer Rights Act). This applies in particular to made-to-measure signage with the Customer's artwork. The Quotation states whether the right of withdrawal applies.

9. Liability for conformity of goods with the Contract

Towards Consumers and sole traders with consumer rights, JKLM is liable for the conformity of goods with the Contract under the Polish Consumer Rights Act, in particular for a lack of conformity that becomes apparent within two years of delivery.

Towards other Customers, warranty liability is governed by the Quotation and, absent different provisions, by the Polish Civil Code. Where JKLM grants a guarantee, its terms are set out in the Quotation or guarantee document.

10. Complaints

Complaints about the Website or completed signage can be made by email to biuro@jklm.eu, by phone or in writing to JKLM's address. Please include your contact details, the project, enquiry or order number, a description of the problem and, where possible, photos.

JKLM responds to a complaint within 14 days of receiving it, on a durable medium.

11. Out-of-court dispute resolution

A Consumer may seek help from the municipal or district consumer ombudsman, the voivodeship Trade Inspection office or a permanent consumer arbitration court. Information and addresses are published by the Polish Office of Competition and Consumer Protection (UOKiK).

12. Personal data

The processing of personal data is described in the Privacy Policy.

13. Final provisions

• JKLM may amend these Terms for important reasons, in particular changes in the law or in the Website's functions. Amendments do not affect acquired rights or Contracts concluded earlier.
• Matters not covered are governed by Polish law. This choice of law does not deprive a Consumer of the protection of mandatory provisions of the country of their habitual residence.
• Disputes with Customers who are neither Consumers nor sole traders with consumer rights are resolved by the court competent for JKLM's registered office.
• The Polish version of these Terms is binding. Versions in other languages are for information only.
